GERMANY: BaFin publishes guidance on EU short selling exemption

BaFin has published a Guidance Notice dealing with the form of the notification of intent for Germany market making activities and Germany primary market operations under Article 17 of the EU Short Selling Regulation. The Guidance Notice provides information on how to deal with notifications under applicable national law that will coincide in time with the notifications of intent to be submitted pursuant to the EU Short Selling Regulation. There is a 30-day waiting period after giving notice to BaFin until entities may start to rely on the exemption.
