On 2nd January 2018, the Federal Financial Supervisory Authority (BaFin) announced that it will defer the application of Article 35 of MIFIR until the 3rd of July 2020. Article 35 provides that a trading venue has the right to non-discriminatory access to a CCP if certain conditions are met.

However, pursuant to Article 54 (2) MiFIR , the application of Article 35 MiFIR to exchange-traded derivatives may be excluded for a transitional period until 3rd July 2020 at the request of a Central Counterparty to the competent authority .

Bafin has therefore used Article 54 (2) MiFIR to delay the application of Article 35.
