On 9th January 2018, the European Securities and Markets Authority (ESMA) has published a list containing the Trading Venues have availed of the temporary Exchange Traded Derivatives (ETD) opt-out scheme. Under Article 36(5) of MiFIR a trading venue may notify ESMA of its intention to temporarily opt-out from the access provisions for exchange-traded derivatives (ETDs) provided its annual notional amount traded of ETDs falls below a certain threshold. The following trading venues have opted out of the Open Access Scheme:

  • MEFF Sociedad Rectora del Mercado de Productos Derivados S.A.U. Spain
  • Oslo Børs ASA Norway
  • Giełda Papierów Wartościowych w Warszawie Poland
  • Athens Exchange S.A Greece
  • Nasdaq Stockholm AB Sweden

 Similar opt out provisions exists for newly established CCPs that intend to temporarily opt-out from the access provisions in respect of transferable securities and money market instruments. However, at the time of publication ESMA has not received any notifications for such temporary exemption.
