The Autorité des marchés financiers (the “AMF”) is seeking comments on the proposed amendments to the Derivatives Regulation to adapt it to rapidly changing derivatives markets.

One of the main proposed amendments introduces the requirement to deliver certification for persons acting exclusively as hedgers, as defined in the Derivatives Act, in order to assess whether they should have additional protection when carrying out derivatives activities.

The AMF is also proposing to amend the training, education and experience requirements of individuals wishing to register as advising representatives, associate advising representatives or chief compliance officers of derivatives portfolio managers.

The AMF is inviting interested parties to consult the Notice and Request for Comment and submit comments before February 13, 2016.
