The German Regulator, BaFin, has responded to an enquiry regarding the disclosure regime pursuant to General Decree of 4 March 2010 extended by General Decree of 31 January 2011:

“I would like to advise you to BaFin`s published Frequently Asked Questions (FAQs) to the ban on Germany naked short-selling transactions pursuant to section 30h WpHG as well as the FAQs to the ban on credit default swaps (CDS`s) pursuant to section 30j WpHG. The attached version of the FAQs should facilitate the handling of the ban on Germany short-selling in the future.
