GERMANY: BaFin consults on EU Short Selling Regulation

The German regulator BaFin has published a draft regulation on net short positions, which includes amendments to the existing regulation on net short positions. The rules are to aid implementation of the EU Short Selling Regulation which enters into force on 1st November 2012. The rules relate to the notification and publication of net short positions, including a requirement to submit notifications electronically, and details of the information requirements to be satisfied.

Registration for using the electronic reporting platform is required prior to submitting the first notification, and the registration form must be printed, signed and sent to BaFin by mail.
