Due to the European regulation on central securities depositories, the Autorité des marchés financiers (AMF) is launching a public consultation, on amendments to Book V of its General Regulation on Market Infrastructures.
This Consultation will run until 28th February 2018. Adopted in July 2014, the European regulation on the improvement of securities settlement in the European Union and the central securities depositories resulted in an amendment to the Monetary and Financial Code by ordinance in December 2015.
The AMF has amended Book V of its general regulation, dedicated to market infrastructures.
The AMF proposes amendments to:
- consolidate the provisions relating to the central depository and those relating to the settlement and delivery system for financial instruments and insert securities for better legibility;
- adapting the provisions concerning the content of the operating rules of the central depository and the supervision regime of the latter by the AMF;
- specify the professional card regime applicable to the central depository as provided for in the Monetary and Financial Code;
- modify the conditions for participation of credit institutions and investment firms outside the European Union in post-market infrastructures;
- adjust the provisions relating to the fight against money laundering.
