On 7th February 2018, the European Securities and Markets Authority (ESMA) updated its Questions and Answers regarding transparency issues under the Market in Financial Instruments Directive (MiFID II) and Regulation (MiFIR).
The updates to the document concern the following issues:
- Pre-trade transparency waivers: Pre-arranged/negotiated transactions for non-equity instruments Article 9 of MiFIR
- Pre-trade transparency waivers: Minimum size of orders held in an order management facility for non-equity financial instruments
The purpose of these Q&As is to promote common supervisory approaches and practices in the application of MiFID II and MiFIR.
ESMA periodically review these Q&As on a regular basis to update them where required and to identify if, in a certain area, there is a need to convert some of the material into ESMA Guidelines and recommendations.
