Further to the update on 12 February 2013regarding ESMA’s call for evidence on the EU Short Selling Regulation review, a series of responses have subsequently been published by ESMA on 19 March 2013.
The call for evidence was initially published following the receipt of a formal mandate from the European Commission seeking technical advice on the evaluation of the effects of the EU Short Selling Regulation. In order to prepare its technical advice on the effects of the Regulation, ESMA invited investors, market participants and any other interested stakeholders to provide responses to the questions outlined in the Call for Evidence by 15 March.
35 responses were received in total from a range of investors and market participants spanning the European Union.
ESMA’s advice is expected to be delivered to the European Commission by 31 May 2013. It will contribute to the Commission`s report on the review of the Short Selling Regulation, which it is obliged to present to the European Parliament and the European Council by 30 June 2013.
