The European Securities and Markets Authority has published for public consultation draft regulatory technical standards on the European Electronic Access Point (EEAP) under revision to the Transparency Directive.
The amended Transparency Directive 2013/50/EC (TDA) was published in the Official Journal of the European Union on 6 November 2013 and entered into force on 27 November 2013. ESMA is required to develop and submit draft Regulatory Technical Standards (RTSs) setting technical requirements regarding the access to regulated information at Union level to the European Commission (Commission or EC) by 27 November 2015.
Included in the register will be major shareholding notifications filed pursuant to the Transparency Directive requirements.
The consultation is composed of five sections corresponding to the following five draft RTSs, as required by article 22 (1) of the Transparency Directive; four of the RTSs are directed to OAMs (national storage mechanisms) and one is directed to ESMA:
a. RTS on search for regulated information (directed to ESMA)
b. RTS on technologies used by OAMs
c. RTS on the unique identifier used by OAMs
d. RTS on the common format for the delivery of regulated information by OAMs
e. RTS on the common classification of regulated information by OAMs.
The consultation runs until 30 March 2015. ESMA is required to submit the draft RTSs to the European Commission by 27 November 2015 for endorsement.
