The Danish Financial Services Authority, Finanstilsynet, have published a number of ordinances regarding approval requirements for third-country Alternative Investment Funds (AIFs) and their establishment and marketing in Denmark.

The approval requirements are summarised in the following;

  • An ordinance authorising alternative investment fund managers (AIFMs) from a third country to market AIFs within the European Union or a country in which the Union has concluded an agreement with the economic area in Denmark. The Order details the information requirements which must be satisfied in the application for approval to the Danish FSA;
  • An ordinance authorising alternative investment fund managers (AIFMs) to market to retail investors and;
  • An ordinance authorising Alternative Investment Fund Managers (AIFMs) for marketing of alternative investment funds from a third country in Denmark.
