The Czech National Bank have responded to a query concerning the format of notification to the competent authority concerning the Market Making and Authorised Primary Dealer exemptions under Article 17 of the EU Short Selling Regulation on Czech Republic short selling. The Bank were also asked for guidance on how to use the online web portal for the reporting of net short positions. The Czech National Bank provided the following response:
“As regards the method of notification to the Czech National Bank in order to avail of Market Making and Authorised Primary Dealer exemptions under Article 17 of the Shortselling Regulation there are no specific requirements other than using one of the forms published in Annexes III and IV of the ESMA consultation paper No. 2012/580.
Notification of short positions to the Czech National Bank is made via our web portal. No prior registration is required – a person notifying a short position has to login as unregistered user providing his/her first name, last name and email address (a confirmation of receipt of the notification is sent to that address). However, an advanced electronic signature based on a qualified certificate is required for an appropriate submission of the notification. There are only support files and manuals available which are needed in order to successfully sign the notification.”
