On 7th November 2017, the Ontario Securities Commission (OSC) announced that it has adopted the OSC Rules of Procedure and Forms (Rules) and the Practice Guideline (Guideline).
These rules outline the actions which the OSC is entitled to take if Market Participants fail to carry out investments in the necessary manner.
The objective of the Rules is to ensure that Commission proceedings are conducted in a just, expeditious and cost-effective manner.
The Guideline assists with the application of the Rules and sets out timelines for procedural steps in Commission proceedings.
The Rules and the Guideline apply to all proceedings where the Commission is required to hold a hearing, or to afford the parties an opportunity for a hearing, before making a decision.
The Rules and the Guideline are available on the Commission’s website, under the heading Rules of Procedure and Practice Guideline.
The Amendments were made effective on 31st October 2017.
