The Commissione Nazionale per le Società e la Borsa (CONSOB)  has published guidance on commodities position reporting obligations under MIFID II.

The Guidance is relevant to:

  1. trading centres where commodity derivative trading is carried out. The guidance states that there is an obligation to provide the competent Authority with a report containing the complete breakdown of the open positions in said trading centres relative to all the parties including members and investors and the relevant clients;
  2.  investment companies that trade OTC (Over the counter) commodity derivatives, equivalent in economic terms to those traded on a trading centre in the obligation to provide the authority competent for the trading centre with a report with the complete breakdown of the positions of the aforementioned derivatives.
